Terms and Conditions
- Identity of the Entrepreneur

- Applicability
2.1 These general terms and conditions apply to all offers, agreements, and deliveries of CHISADI concluded via the website or otherwise at a distance.
2.2 By placing an order, the customer agrees to these terms and conditions.
- Offers and Products
3.1 All offers are non-binding and subject to availability.
3.2 Product descriptions, images, and specifications are provided as accurately as possible. Minor deviations do not entitle the customer to cancellation or compensation.
3.3 CHISADI reserves the right to refuse or cancel orders if reasonably justified.
- Prices
4.1 All prices are stated in euros and include VAT, unless stated otherwise.
4.2 Shipping costs and any additional charges are clearly displayed before the agreement is concluded.
4.3 Price changes do not affect already confirmed orders.
- Agreement and Orders
5.1 The agreement is concluded once the customer receives an order confirmation by email.
5.2 CHISADI reserves the right to cancel the agreement if payment is not received or if incorrect information has been provided.
- Payment
6.1 All payments must be made in advance using the payment methods offered on the website.
6.2 CHISADI may suspend or cancel orders in case of non-payment.
- Delivery
7.1 CHISADI aims to dispatch orders within 5 business days, unless stated otherwise.
7.2 Delivery times are indicative and not binding deadlines.
7.3 CHISADI is not liable for delays caused by third parties, force majeure, or customs procedures.
7.4 International delivery times may vary due to customs clearance and international transport conditions.
- Right of Withdrawal (EU Consumers)
8.1 Consumers residing in the European Union have the right to withdraw from the agreement within 14 days without giving any reason.
8.2 The withdrawal period expires 14 days after receipt of the product.
8.3 Withdrawal must be communicated in writing (by email).
8.4 Products must be returned unused, unworn, and in original packaging within 14 days after withdrawal.
8.5 The consumer bears the direct costs and risks of return shipping.
8.6 CHISADI will refund all payments received, including standard delivery costs, within 14 days after receipt of the returned goods, using the original payment method.
- Exclusion or Limitation of the Right of Withdrawal
9.1 The right of withdrawal does not apply to:
- Products made to the customer’s specifications or clearly personalized;
- Sealed products that are not suitable for return due to hygiene reasons once unsealed.
9.2 For customers residing outside the European Union, the right of withdrawal may be limited or excluded to the extent permitted by applicable local law.
- Conformity and Legal Guarantee
10.1 CHISADI guarantees that products comply with the agreement and applicable Dutch consumer law.
10.2 Defects must be reported within a reasonable time after discovery.
- Liability
11.1 CHISADI is not liable for indirect or consequential damages, including loss of profit.
11.2 Liability is limited to the amount paid for the product concerned.
11.3 These limitations do not apply in cases of intent or gross negligence and do not affect statutory consumer rights.
11.4 CHISADI is not liable for damages resulting from use of the products in countries where such use is restricted or regulated.
- Force Majeure
12.1 CHISADI is not obliged to fulfill any obligation in case of force majeure, including supplier failures, transport disruptions, strikes, government measures, or customs restrictions.
- Complaints Procedure
13.1 Complaints must be submitted in writing within a reasonable time after discovery.
13.2 CHISADI will respond within 14 days of receipt.
- Intellectual Property
14.1 All intellectual property rights relating to the website, products, texts, images, logos, and brand name belong to CHISADI or its licensors.
14.2 Unauthorized use constitutes an infringement of these rights.
- Privacy
15.1 Personal data is processed in accordance with applicable privacy legislation and the CHISADI Privacy Policy.
- Applicable Law and Disputes
16.1 All agreements are governed by Dutch law.
16.2 If the customer is a consumer residing in the European Union, this choice of law shall not deprive the consumer of protection under mandatory provisions of the law of their country of residence (Regulation EC 593/2008 – Rome I).
16.3 Disputes shall be submitted to the competent court in the Netherlands.
- Amendments
17.1 CHISADI reserves the right to amend these terms and conditions.
17.2 Amendments take effect upon publication on the website.
- International Orders (Non-EU)
18.1 Orders shipped outside the EU may be subject to customs duties, import taxes, or other charges. These are the sole responsibility of the customer.
18.2 CHISADI is not responsible for customs delays, refusals, or seizures.
18.3 If an order is refused or returned due to customs issues, shipping costs and incurred expenses will not be refunded.
